Necessity of NOC from Tehsildar

Is it necessity to take the No Objection Certificate from Tehsildar for the Sale of Property in Regularized Colony which has regulariezed and approved by Standing Committee of Municipal Corporation of Delhi in 1978.  The Colony is approved for Residential Purpose.  The Nature of  Property will not changed after sale of property.

Why the Sub Registrar is insist for taking the NOC from Tehsildar for Registration of Sale Deed.

If anybody have a law, legal opining or circular, pls email to goel.mukesh@gmail.com

Dear Mr.Goel,

Your problem seems to be the of flimsy ground of denial by Tehsildar for giving NOC and nothing more.  Go and file a RTI seeking reasons why the NOC is not been given and remove the anamoly for once and all.

To my mind both of them are taking shelter of not knowing the status of  the property i.e. the same is being regularised.  Represent to them in writing and ask them to take a stand.   All the very best.

Regards

Daksh
