Need proper guidence for divorse case

sir i had married with divorse girl  last yr which i knows before her marriage again come in contact and after her divorse due to my emotional nature i get forced married
with her in temple due to her family pressure but after marriage she is harrising
me for every thing ,she is suffering from venerial disease & also having 9 yrs daughter also living with me its my first marriage & due to such incident i and my family is totally distrub i am alone son for my parents they think why it happen now i want get seperate from her but she is now harring me that if i live her she can put 498 & DV against my family as my family member are not present in my marriage and i am living seperate with her then also she is treating like this .
what to do i am really in tension pl give me a proper way to get seperate from her and have my married life. in emotion & in distrub mind i had done marriag & also not registered pl suggest  right way .

are you sure that she got divorce from her 1st husband?

If you can prove that your so called marriage which took place in temple is not a marriage (no marriage cards, no photos) then 498A is not for you.

1. Knowledge of her status yet marrying her and now asking remedy for divorce for the same you need to find grounds for divorce simply sayign I am emotionally distrub is no valid ground for divorce at all.

2. She may file all those which she talks about, best is to sit and solve yoru problems with her or if you have capacity then agree to her demands and part under mutual consent divorce.

3. I disagree to first repliers reply. A trial Court needs to prove if it was a valid marriage or not and meanwhile S. 498a / DV can very well get admitted so facts which are not adjudicated properly by a competent court one cannot simply say; oh S. 498a / DV will not apply in the beginning is not right.
