Need help in the hurdles faced in the society formation process.
We have already started society formation process without co-operation from builder. We sent him 1st notice to form society in Feb 2014 and he rejected it. After that we filed case in registar, Sakhar sankul Pune and notice was sent to builder in starting of Mar 2014 from registar.
We had first hearing at Sakhar Sankul on 26th Mar where advocate from builder ask us documents. We submitted all documents. 08 April 2014 we had 2nd hearing and now his advocate submitted Apartment formed document with the help of 4 people. Deed of declaration started on same day of registart notice(Mar 2014) and 4 peoples signed after certain intervals before first hearing. This all things were happened after our first notice to him.
He is recommending that apartment is already started hence society can not be formed.
We don't want apartment and all 15 other members desperately want co-operative housing society. Majority people want housing society. We have initiated this process first.
Please suggest us which all things we need to put for next hearing.
