Notice u/s 8o of the civil procedure court, 1908

Regarding a suit filed on the postal department

 I communicated through letters and faxes with postal department but they did not respond and kept delaying the compensation so I filed my suit in the consumer court. My query is :

Is it compulsary to send notice u/s 8o of the civil procedure court, 1908 to Post Office?

I have not sent any notice to postal department. What is the downside for not sending in the eyes of consumer court and how I can cover it up as I am going to file the rejoinder

Your case in Consumer Court will stand even without a Notice U/S 80

This section is not applicable to cases filed under Consumer Act

So, In response to the content  " That no notice u/s 80 of the civil procedure court, 1908 was given by the complainant before filing the complaint to this Hon'ble consumer forum" .

 

Please note that it is a postal Department  (Government) against whom suit is filed.

 

What would be my best reply?
