Certainly, and first apply to the Tehsildar and produce income certificate from all sources.  Make an attempt, either you can get such certificate with eligibility and if it is rejected you will be informed of the reasons.

It is the Tehasildar that has to consider those guidelines and decide as to whether such applicant is eligible for NCL or not.  Approaching for certificate and informing facts as per application is not improper.
