court will permit application for amendment aslong as it does not prejudically affect the defendants . as issues have not yet been framed court may allow application if no new case is sought to be made out

Since issues has not been framed yet in case so proposed amendment may be allowed if the same does not change the nature of case .

but I need judgement where amendment is not allowed due to the lack of sufficient time.
