Ownership of property

Hi

I have 2 flats. For 1 flat, Primary owner is wife, secondary me and third is mother.

For 2nd flat, Primary owner is me and secondary is mother. The same is the case for my brother for his 2 flats. We also have 1 sister.

Basically can you please advice, how the ownership from my mother to transfer to us so that we can transact the flats without any hassle in future.

Also, if there is no will or deed made by our mother, what consequences will be faced?

Get a registered relinquishment deed from your mother. One deed is sufficient for both the properties.

 

A will becomes operative only after the her lifetime and may be contested. A will also can be nullified later by executing a new will.

the mother can relinguish her rights in her share through a registered relinguishment deed done in your favour.

if she dies intestate (no will) then her share will devolve equally over her husband and children
