Hello,
You have to get a legal heirship certificate from the court to transfer the flat in your name. If your flat building is having society and nomination is registered with society then you can transfer flat in your name.

To begin with, if the property is jointly owned by you and your deceased spouse, the property would be automatically transferred to your name. You need to preserve a notarized copy of your spouse’s death certificate and the papers of the property in which the property is registered jointly to both of yours names. With the help of a local property lawyer, get the property registered solely to your name, forfeiting the previous registry.
When it comes to the selling of the property, the registered deed, sale agreement and all the necessary documents should be compiled together, making it easier for you to pursue a buyer. Take the help of a lawyer in this practice.
