Pagadi property in mumbai

my uncle (mother's brother ) died in mumbai he was unmarried and my mother is only sister ( she is also no more ) now my uncle have one one room kitchen house in mumbai in one chawl in pagdi system. this room he got from his father (my mother's father ). and they have that room since more then 50 years. now my uncle has made a will in our favour ( my self and my sisters ) he has mentioned all his belongings including this room . but the building owner is refusing to transfer it on my name or dont want to give any money. he has planned to make new tower on this place. so can i have any rights on this property ? what can i do for to claim it and get it. this owner is new he is a developer and he has purchased this property from the original owner. ( building have 55 flats , and most of are occupied by the residents )

please check and confirm have your unclue paid the entire monthly rent to the owner of the property? if yes, then you have a right to the property by way of will.

has the new owner of the property had accepted any rent from you?

who has the keys of the room?

yes my uncle has paid all rent up to his death. he expired in march last year even after that also we have paid rent up to sept. 2011. to the new owner. we have reciept. and after that he has refused to take the rent once we have tried to send by money order but he has returned back ( as we are living in gujarat) and the key with us but i got news few days ago he has brokcen the lock and fixed his own lock. but still my uncel's all house holds are in the room. i am out of station , but with in to days i will call you . thanks

Dear Divyesh,

In that case you need to serve a legal notice through advocate on the Land Lord immediately for handing over the possession back to you. if still he does not give you the possession then you have to file a case in the court.
