Pagadi system apartment in mumbai

We have lived in a pagadi system home in a Chawl in Mumbai for last 50 years. The landlord is not friendly. He filed a court case in 90s to evict us but he lost the case. My father lives there now. The landlord has filed a case again to evict him on the ground that now my father should vacate and live with his son (me as I have a 1BHK in Thane. The reason he gives is that he needs the property so that he could stay with his family there.

What are our chances in the court case and is there any way we could sell the property and not have the hastle of going through the court case again.

(1) The landlord cannot get your father to vacate simply for the only reason that his son has a 1BHK flat at Thane. However if he can prove his bonafide need for his own use he may succeed. (2) You are only a tenant and residence for a long period does not make you an owner, you cannot sell the flat.
