Please help me

my father as given a money to a person by cash ₹280000 for which he has given
1.blank cheque
2. Promising Note signed
3. A4 sized paper signed

my father as expired on 20/04/18

he says he has cleared

what is the legal opinion?
is it good to go for legal

Dear!

You should first try to settle without judicial intervention as that will take this a long way. Show him the entries of the account and let him know that the amount has not been cleared and he should do it or legal notice shall be issued.

If that does not work, engage a good lawyer and serve legal notice on him to have the amount given back. If even that does not work you can, WITH THE ADVISE OF THE SPECIALIST, go for a suit and even claim the black cheque if it is best advised at that time. Also the signed papers will have him in a fix in no time and he shall have to repay. A specialist will help you with more than one ways to deal with the same.

I would be great if you can record the same statement on phone. If he is not ready to pay now and says, do ehatever you can, just issue a legal notice. The same should be served by a comoetent kawyer who can draft it in a way that the opposition knows that he is in a bad position. However, if you can settle the things by talking and he promises to give money in some time then take it on papers and let him pay the money in some days.

No one case assure or guarantee on competence and sincerity / honesty of Advocates at Bangalore.

Being a local person, you may be having many friends  to Advocate and you are having blank A4 paper and blank cheque.

Criminal cases are of doubtful success.     Civil Suits are of much success.     You will, in all probability, win.      But what you get will be less than what you spend.     The harm to the other party will be more miserable.

Do you think he'll be ready to be ruined for the sake of prestige?

If so, both of you will lose and advocates and judges will gain.

Absolutely true.  Every one knows the bitter truth, still wants to go after such litigation, spending hardearned money and sacrificing mental peace and it is too late to learn a lesson by them.  Prestige....ego..... Justice.... Cause...etc., are such reasons for most of the litigations.
