Please help need divorce

Dear Friends,

I am married in march 2011.He took my belongings and my asserts forcibely and throwed me out of the house with the help of his parents.As i was scared about his actions i filed 498a and Dvc case on him and his parents.But as their lawyer removed his parents names from 498a case.And when coming to Dvc case from the last 3 hearings they were not attending to court.And also petitioned to court by saying we didnt take any of her belongings and asserts.

My question is what to do to add his parents names in 498a case and what to do to regain my asserts and maintenance money.?

please help me friends as i lost everything because of him.as per reality he throwed me outside without giving my clothes also.I want justice.what i have to do now?

please help me.

1) you have not emntioned your husband  income . whether you are working or not ? you would be netitled to maintenance under DV act

2) you also have right to stay in shared household . you cna ask for laternative accomodation .

 

3) as far as 498A case is concerned if your streedhan is with your husabnd he is bound to retrun it . if you have filed complaint aginst his aprents and your husband then they must have made application for anticpatory bail . it is necessary to go through order passed by court as to why parents name have been removed from 498A case

Thanking you sir,

                          my husbands monthly income is 60,000 rs..and i am not working sir because somebody told that if i work then he dont pay compensation to me so iam not working.i asked for maintenance and also for accomdation.but the court is very slow in my case.now what should i do?

you will get necessary reliefs . if your husband is earning rs 60,000 a month you are entitled to maintenance as you are a housewife . you also have right to stay in shared household . have you applied for interim reliefs under DV act . your lawyer should press for interim reliefs to neable you to make ends meet .

If u r well educated and capable enough to earn, then court may not grant u maintenance depending on ur education details or may give u some monetary releif and it would be like a pinch of salt in flour....So maintenance will be very less if u dont have any kids involved ....

U can ask for shared household only if u stayed in shared household......Nonetheless, u can not ask for staying in his parents house if u never stayed there or if u stayed there for a limited time and then stayed in different place afterwards. All depends on ur situation.

thnku for ur opinion but nenu revenge terchukovali ani anukoledhu vallu nannu torture chesaru kabatti case petta anthe and mediator dagara settlement pettinapudu vallu memu emi ivvam annaru anduke case petta anthe kani nenu love chesina hubby medha case pedataniki nakemi pichi kadhu...

dear purnima

case winnimg in a court is mostly depend up how  u r lawyer framing the case . In your case  u can  return to  u r husbend home  with the help of women commission and file a petition to instruct u r husbend dont expell u from his house....

 

..in many cases court has ordered that whether wife hasany  income or not  is not a consideration for the payment of maitanace ..

 

u should plea to the court for each and every u r need  then only court will take  a decision and issue order court will consider only  the matter which is   rised before it .

 

How the other party's ADV: deleter the name of parant from the complint????  it is not possible only court can do it
