He cant stay away from Court always.If he does not appear in the court will issue summon then warrent agaist him.So he is bound to appear.Just keep patience and get indulged yourself in some other activities.Try to stand on your own feet.

What reliefs you have asked in DV case?

Go and take necessary action as well as file divorse.Do'nt worry you will get your goal.

i differ with the advises given by the above members. 498 will also destroy you. both mentally and physically, you will also run around the courts for years together and gain nothing, your statements are bald unless you have specific proof which are ' beyond reasonable doubt' to nail them, else you are just wasting your 'biological' time  in literal sense. you will waste your precious years of youth in this mess..think again and move away peacefully
