POCSO

I have come across the new judgement from Bombay High Court which states "Exposure of Private Parts to someone will not be considered under Rape and groping without skin to skin touch will not be considered under Rape!"

I would like to know if this judgement supercede the POCSO act too?

Because, according the the whole idea of the particular act is to safeguard the children from s*xual harrassment on whatsoever scale it is... For adults it is understood, but what about the children who does not even understand what is happening and cannot differentiate between right or wrong.as these types of acts may target them psychologically.

It appears that the appeal is pending at SC and the concerned judge that delivered similar judgments was not considered for appointment of a regular HC Judge as per collegium orders.   Search in google and you can find the latest developments.
