Ppf deducted from an employee's act

I would like to know if any action can be taken if a company is deducting PPF from an employee's salary but that is not shown in the salary slip. What can be done regarding the same as an employee does not have a proof for the same but he/she knows his/her PPF gets deducted of the company as well as the employee itself.

It is believed that the query is for PF and by oversight is it is written as PPF.

 

It shall be appropriate to check if you are eligible for PF or not?

 

It is not clear that the employee is regular employee, contact labor, and the establishment is Commercial or Industrial and it is in which state………………………..

 

And whether the standing orders apply to the establishment and have these been extended to employee or not……………

 

The Min. Wages Act applies to the establishment or not………………the notifications issued by state govt. may be seen………………..

 

 

-----------It is mandatory to issue and supply the wage slip, before the wages are disbursed and both employer and employee should sign it and thus confirm the correctness of detail of disbursement of wages and deductions if any made by employer……………….

 

It is mandatory to record in the wage slip issued to employee by employer: the earnings of the employees and deductions at source made by employer

 

 

Min. Wages Act 1948: Sec 18 (3)………….

 

Min. Wages central Rules (1950): Rule 26 (2) (3)……….Rule 26(2) Form (xi)…………

 

Payment of Wages Act: Sec 13A

 

CLRA : 78 (Muster Roll/Wages Register/Deduction Register/Overtime Register) 1 (a) (i) , 1 (b)…………………..

 

Shops and Establishments Act: Record and Registers: Employer should maintain register of employees, salary register and record of salary paid every month……………..

 

 

Under the factories act, a Labour Inspector can ask and issue a legal notice to the factory manager / occupier for showing the signed pay slip for last six month.

 

If PF number and deductions at source by the deductor ( employer) are not shown in salary slip raise a demand with HR personnel ( then HR-Head/ appointing authority/MD………….) to supply the details and explanation in writing under acknowledgment………………………….and also the PF account slips of all years of employment by redg. post.

 

If the concerned HR personnel, HR Head, Appointing Authority, MD does not resolve lodge a complaint with Labor Inspector with a copy to ALC, DLC, Labor Commissioner, Secretary-Dept. of Labor, President/Secretary of local registered Trade Union………….Factory Inspector, Inspector Under Shops and Establishments Act, Wages Inspector, RPFC……………………

 

-----------Since your employer is issuing wage slip but is not showing the PF number. PF deduction in wage slip, you may raise a demand to supply you the PF number and PF account slips of all years of your service by redg. post.

 

If the PF office where your PF a/c is maintained has started to issue the PF pass book, demand the same thru your employer.

 

If PF account slips/pass book/PF number is not supplied lodge a complaint thru RPFC at your location.

if the employer is listed in list of defaulters…………………….and 7 A proceedings are initiated against it………………….

 

 

You may peruse RTI route to obtain from PIO/CPIO of  EPFO and obtain certified copies of  Form 3A, 6A, 23 , 24…………………….
