Precautions while vacating rented flat

Hello Everybody, I am planning to vacate the rented flat. What precautions I have to take while moving out of the flat ? like, first take the deposit money or cheque then handover the keys or do not vacate the flat until all security deposit is received I had a small issue with flat owner. The issue is that I was planning to buy the rented flat but owner doesn't have the necessary property documents with him. so the deed was canceled. Now, he is asking vacate my flat then I will give the security deposit. so, what should be the next step ? I have the xerox copy of rent agreement which is registered in registrar office. Dear Amit,

 

You need to first check your Rent Agreement , as to whether there is a clause in the same stating that possession of the premise to be handed over only upon receipt of the Security Deposit. If such clause is there , send a letter to the Flat Owner giving reference of the said clause and asking him to refund the Security Deposit before you handover the possession.

 

In case, there is no such clause in the Rent Agreement, you are advised to send a Letter to the Flat Owner stating that you are ready to handover possession of the flat only upon receipt of the Security Deposit.
