Prob in a multi-storeyed building

My elder sister stays in Kolkata, in an apartment in a multi-storeyed building, on the ground floor. A person who stays on the 3rd floor, owns a small shutter-covered space on the ground floor which is positioned just beside my sister's apartment's southern balcony. This balcony is the only balcony in the apartment and is the only source of light and air of the eastern room of the apartment. Recently, the shutter-covered space has been rented to 3 persons who have started a fast-food shop in the space. Their cooking begins from around 5pm and continues till 10pm and beyond. The entire gas, smoke, etc emitted during the cooking loiters around the shop, on the road, and enters my sister's apartment's balcony and rooms, making it a nightmare, full of cough and tears, to reside in the place in the evenings. The owner of the space was approached and the problem was mentioned but he, as expected, was not interested in providing any solution. The building's Association's top brass is apathetic and stressed on "they have trade license... so, what can be done?", etc. Can anyone suggest what is to be done, given the present situation?
