process of buying land

Dear Esteemed members,

Please can you advice me as to whether the procedure for buying land is okay.

1. X is going to buy land from Y and Z both being POA holders of A.

2. Agreement to sell made for advance payment. Is it necessary to register the same.

3. Final sale deed after payment of remaing consideration after  2 months. 

4. When/what stage shall mandal be taken to measure the land and pillar put up as a sign of demarcation by the purchaser.

It is advisable to register the agreement of sale to avoid future litigations and furthermore, under the Registration Act it is mandatory to register the agreement. With reference to your query regarding the posting of pillars it can be done at any point after registering the agreement.

To register a land first we have to present the agreement to sell/final sale deed before the concerned registration office. Both the purchaser and seller alongwith witnesses should be present. Then sub-registrar shall register the sale deed by taking thumb impressions of all concerned. The parties/party has to submit the necessary stamp duty based on the valuation and also registration charges.
