dear Experts I booked an under construction flat in Mulund in year 2011. Its a redevelopment project in this there are two wings one is 14 storeyed which is for original tenants and other wing is of 21 stories which is for SALE only. Till date in 6 slabs in tenant wing and 4 slabs in sale wing have been constructed. When we used to ask builder about stoped constructions he used to give name of some government authority and used to say that he is not giving CC for further construction. Then when that government authority got retired we asked builder about further construction and builder always used to give falls promises that CC is now expected in a month's time, two months and three month's. Now two weeks back some fiancer approched us who was nominated by builder himself and called for meeting. In that meeting the financer told us that builder has no money left with him and can not continue this project, i will now take over this project and you all have to pay me new booking rate Rs 12500/- per sq ft so that he will carry out the construction. This new rate is more than double the rate at which we booked flats in year 2011. A week back we got a news that Builder, financer and society all are getting in to tri party agreement, Now my question is if they register a tri party agreement then what will happen to our rights? Secondly financer told us that society can terminate their agreement with builder at any point of time as the builder have defaulted them, and if they do so you will not have any rights there after. Thirdly i have booked flat in tenant wing on 5th floor for which i have done the registration also in year 2011. Need a guidence how i can fight for my rights.
