Hello:
Bought a property in a SARFAESI auction in August 2012, registered the property in September. Took physical possession in presence of a Sheristadar and police in November. The previous owner refuses to clear his stuff and it is still lying outside. I am having difficulty renovating the house since all the stuff are lying outside. The borrower has filed a WP which has not been accepted. My lawyers as well as Bank lawyers have filed their objection. The borrower has filed another WP challenging SARFAESI as unconstitutional.
What are my options to get rid of all the articles ?
Should my lawyers file a separate suite in court ?
or is it the bank's responsibility ?
