My father wrote all the property in my mothers name and my mother is mentally ill. She has no understanding of the property values and she has been mentally ill for almost 10 years now. Since, the property is in her name and we would like to dispose it to invest in another place or even to settle within the family, we have not had any chance to speak to her as she would not listen. It is either her way or highway. She wants to go and sell it and she has no idea about what the property value is nor how much she should sell it for,. So, in this situation we do not know as my father and I are confused in how to handle such situation.
Is there any Indian law where we can prove like in the United States that she is mentally ill and she is not capable of making the right decision. Also, I am not sure even if we try to take her to some kind of Rehabilitation Center to provide her adequate treatment, she would not go and she will create a hell a lot of problems. Also, I live in the US and my parents live in India and with my mother in this state, we are confused what to do and how to handle such a difficult situation. She publicly goes and creates problems for my father as she is mentally depressed and sick and she abuses my father in the streets and in his office building.
Are there no laws that could help such a person? Here in the US, if someone is behaving like this, they would take them and arrest them and put them in a psychiatric ward. But, we are helpless and we dont want to do any such kind of thing, as he feels for his wife even though she is mentally ill. But, my father is unable to take her torture and live with it on a daily basis. Please, help me understand and help me to direct to the correct solution please.
Couple of months she went and sold a land without telling my father and that land was sold for One third the cost from the original price and the buyer was one of my relative who cheated my mother and she took whatever he gave and deposited in her account without telling us. So, she has been doing things like this and we are helpless and we dont want to loose all our property like this because of her mental illness. Appreciate anyone to provide good suggestions and solutions for this problem.
