Dear All,

Ours a housing society of 500 residents owning flats located in Gurgaon.  The Society has installed Noise Free Generators on plots outside the boundry of the Society.  This was done as a adjacent housing society and a few residents had objection to the installation of the Generators within the Colony primarily due to diesel smell and possible noise level.

The hiring of plot(s) outside the Colony is resulting in recurring monthly costs around Rs.5 lacs which is being recovered from the residents monthly as Maintenance Charges for Power Back-up. Some senior members have still objections to the installation of Generators within the Colony. Are there no obligations of the members towards the Society.  If the installation of Noise and Vibration free Generators is approved in a Annual General Body meeting, can the few residents still object ?  Are the Housing societies covered under the Cooperative Housing Society Act or Apartment Ownership Act ?

What is the way forward?
