what you were sleeping when the constrcution was going on..file for police complaint for tresspass or just occupy the construction and claim it is constructed by you as being on your land.

Hello,
1. You can issue him a legal notice to demolish the illegal structure immediately;
2. If he does not demolish the same, you can take help of the police;
3. If you do not want the police to get involved file a suit in the relevant court;
4. The court will verify the land, the documents, the sale-deeds and give the order in your favour;
5. The entire process could take maximum 2 years, but in the meanwhile you can get interim orders in your favour.

Once you admit the possession of the defendant over the land, you shall be required to file a suit for posession which shall not only require the stamp duty but also many years of your life as the defendant is not going to oblige you easily. Even if you win in trial court, he shall file n appeal before Distirct Judge and so on shall remain continued till the end of his remedy, though, you are required to prove your own case on the basis of best evidence in your hand.
You have not posted even the relevant facts which shall definitely change my reply like the nature of the land, when it was purchased/obtained by you, whether you had taken its vacant possession or not, when lastly you visited the site, who was caring for the site, when did the defendant started the construction, how much time has lapsed when he came in the possession, what is his relationship with you, what efforts have been made by you to get the land vacated as on the day etc. etc.
