Property share

My wife filed suit for partition of female 's share over the ancestral and joint family property in the year 2006.my wife got married in the year 1998 and her father and brother entered in to a registered partition deed in the year 2003 and they partitioed between them to deprive my wife rights over ancestral and joint family property  but my wife is not a party to the partition.

My wife has rights as per the karnataka amended act but the defendants taken contention that karnataka amended act has been went out in view of 2005  central act , as per central act there should not be a partition before 2004.

Sir we saw some judgments of karnataka we are unable to under stand that my wife has rights in view of karnataka amended act but in view of 2005 my wife looses her right.  please guide us

Any defendant in any suit will certainly deny the allegations or averments.

If it is not a court order then you can proceed suit.

What do you mean by "ancestral and joint family"? Please post the complete facts.

So also, the deed executed is a settlement deed, not a partition deed.
