Ld. Members of this forum are requested to answer questions of law mentioned as above;


1. Whether the case files of disputes pending proceedings before Distt. Court is public property or not ?

2. Whether anyone can inspect these files and can apply certified copies of the same or not ?

3. Redressal/remedy if alleged crime has committed ?

Obsolutely public property. Party can obtain certified copies from the concerned section office in the court.

As you have mentioned that the case files are public property, but you have also added that the party can obtain certified copies.

Then my question is that; whether no party (Third Party) of dispute can inspect the files and can obtain the certified copies of dispute. or not ?

The inspection of pending cases can be done by the parties or the agents.

The Delhi High Court Rules, in this regard, state that, “the records of pending cases will be open, as of right, to the inspection of parties or their authorised agents or any Advocate of the Court, who is duly authorised to act in the case or junior counsel whether he be an advocate of a pleader of such duly authorized advocate provided the latter certifies on the application that he has authorized his junior to inspect the record for him. Provided that an Advocate of the Court may inspect the record of any such case on giving an assurance that he is in communication with one of the parties with a view to being retained in it.”

It is also mentioned that with the exception to the above mentioned persons, no other person is allowed access to the record of a pending case without the special order of Judge.
