Query

sir

 i am a pensioner and already lost hefty amount paid to estranged wife as one time settlement+legal professional charges in my mcd case. i want to know your esteemed opinion about my following queries:

  1. is there  any schedule of legal practitioners fees to regulate fees charged by lawyers?

  2. what are charges in practise to handle divorce, mutual consent divorce case a) at indian family courts by lawyers?

     b)what are charges in practise to handle appeals at indian high courts arising from orders of family courts

 3. i have from my friend that to avail free legal aid annual income should not exceed rupees one lakhs.

     my query is a pensioner draws fixed pension at time of retirement + dearness allowance fixed by government from time to time.

   my query is should we take into account only fixed pension amount to see whether annual income to avail free legal aid does not exceed rupee one lakh?

or both pension and dearness allowance will be taken into account to arrive at eligibility for availing free legal aid?

 we innocent hubbies will be able to win war against estranged wifes if moderate fees are charged and we know answers for above humble queries.

State Legal Services Authority prescribes the ceiling amount to make one qualified to get free legal aid. It varies from State to State and from time to time. Check it with it, sometimes even on on-line. There is no hard and fast rule. Sometimes a glib talk with the concerned official at the office of Legal Services Authority will get you free legal aid.
