Query on applying succession certificate

Dear Learned Members,

Recently I visited a lawyer who advised me that succession certificate can be applied from anywhere in India, no matter where the property is. However, I believe that he is wrong.

I need to apply for Succession Certificate to claim money in PPF account of my late father. Currently following is my condition:

1. Deceased Account in State A, City X

2. Our permanent Residence State A, City Y

(X and Y are cities of same state)

3. My job State B, City Z.

Request you to kindly guide me on the following:

(a) Can I apply for succession in StateB, City Z where my job is?

(b) If not, then can I apply atleast in high court bench in State A, City Y where my permanent residence is?

The thing is the city where the account is about 700kms away from my permanent residence and nobody lives there.

Your advice shall be appreciated.

Thanks.

Regards,

AK

You need to apply where deceased was residing.

Hello Hiral Sir,

Thanks for your inputs. Now the problem is my father was posted to some other city as mentioned above(in state A only) at the time of his death.

Can't I directly go to high court of state A under which all the cities shall be covered?

Where your father expired or at native place from where you collect the death certificate.
