Query related to SRA Flat Transaction.

If a person has some money problem and he approaches a buyer to sell his Slum Structure. The transaction is finalised for 8 lacs and Rs. 1 lacs were paid through cheques as part consideration. The buyer then doesn't pays any amount even after the seller asks him many times and after 4 years the Slum Structure wents in redevelopment and a flat in lieu of the said structure is allotted in the name of Seller and The brother of the seller files a Civil suit demanding 50% share in the said flat and due to this dispute the flat is remains closed till now.

The seller dies recently and the son of the seller approaches the Buyer to cancel the deal and take back his 1 lacs along with interest to which the buyer shows his true colour stating that He has paid Rs. 2 lacs in cash and 1 lacs in cheque from the Total consideration of 8 lacs and as the property now values 45 lacs so he wants 20 lacs to back out from transaction.

The buyer who was also the partner of the developer who developed the flat has smartly taken the Allotment letter and key of the said flat whereas the legal records show that property is in possession of the Seller.

One can not cure cancer with a prescripttion of "Dolos 650', and online guidance is not the remedy for laypersons, as ultimately the remedy has to be secured from a competent court, particularly when the opponent is most influential and powerful.  There were so many such cases reported, and in view of the urgency and final remedy, contact a local advocate or seek legal aid from Legal Services Authority.

Can a SRA flat in slum structure be sold ? I think it cannot be sold, find out from concerned authorities in SRA.

The alleged action of the buyer is illegal. Possession of the key or the allottment letter will not confer him title to the property.
