Question on 125

Hi everybody,

My wife filled 125 Maintenance case in Family Court, Kolkata.

I have attended the case first 2 days and I have submitted my objection on that. Court is not allowing me to appoint any lawyer. Previously I worked in Kolkata but now I have been transferred to other state in India. So it is difficult for me to attend the court every day.

In Family court, next date is fixed for hearing.

Now my question is

1. if I am not able to attend the court that day, will it goes against me and what amount my wife demand in court, can court give judgment for her side?

2. if so, can I appeal against this in other Court, where I can appoint my lawyer?

Please help me to give me proper guidance, so that I can continue my work and at the same time I can contest the case.

You better consult a proper local lawyer and he will guide you in moving appropriate application with appropriate reasonings before the court seeking permission for appointing a lawyer. Do not skip the next date and appear in the court along with the advocate, and he/she will handle the rest.
