Recording aquittal after sa stage

I am an accused in 498A/306. My SA is closed and no evidence have been placed on record by prosecution except for hearsay statements. 1) Now my Q to learned advocates is that do I still need to go for DE or judge can record acquittal? 2) Will my lawyer need to file application for same or it is by default? 3) or I will have to go through DE stage? Regards

Mr suresh

DE is discretionary power of state government.

Court will proceed according to the fact of case and give judgement.

If it found that your guilt is proved then only DE is conducted by state government.

Thanks. You mean court will proceed only if they find guilt in me at this stage and then only call for DE?

Is it that they will reserve order at this stage and then ask me to go ahead with DE else will record aquittal?

 

or my advocate will have to explicitely move an application...?
