'A' v/s State,'A' accused ws held under atrocities act..he has been acquited....the order given by the court say that he is been acquited..but there is no reference regarding the appeal,can the state go in for the appeal .

well the trial court need not to say anything in context of appeal.
first appeal is always a matter of right.
its prerogative of state whether to go in for appeal or not....trial court is not to give any observation or opinion in this context.
