Dear Learned Members,
The driver of the NWKSRTC filed a complaint before the PSI against the driver of goods vehicle for causing accident, Police have acknoweldged the complaint, but PSI filed a FIR and Chargesheet on the bus driver, instead of goods vehicle driver ( who is no more) and criminal case is pending before the JMFC Court.
Sirs Let me know, the driver of the bus( Accused) can file an application before the Magistrate seeking reinvestigation of the case, if so, let me know under what section of Cr.P.C. and whether driver(accused) can file a criminsal miscelleneous case before the Dist., and Session Judge seeking reinvestigation of the case.
