Rejection of job offer after giving acceptance to join.

I got an job offer (Permanent role) from a Pvt Ltd company. I gave my acceptance to join the new company at the time of receiving the offer and my date of joining is on 19/11/2012 . Based on which I have given my resignation with my present employer where I am employed in non-permanent role. Today is my last working day after serving 15days of notice period. Now my present employer is offering me an permanent role in our other branch unit with same package which I am offered in new company. Now this new offer from my present company is great role and it will be a better opportunity for me in both personal and officially.

Now whether I can say 'NO' to the new company where I gave my acceptance to join on 19/11/2012 and go ahead to accept my new offer which I am getting from my present employer. Whether this will make any legal problem from the point of new company where I gave my acceptance.

Note: I Just received the offer letter from new company through email and I gave my acceptance through email. I am not yet received my appointment letter from new company.

yes u can reject the offer of the new employer because it was jst an offer made to you and you will not be legally liable till the time you dont sign the apointment letter

Kindly go thru the offer by email verbatim and confirm if the new company has inserted some clause on claim it can lodge in case you do not join after acceptance of the offer.

Usually companies keep candidates in pipeline for the same job.

You should ask the current employer to confirm to you in writing that it is making the offer of ………..{with designation, dept., role, office address, salary detail etc} and would like you to continue in employment without any break by accepting the offer, and notice of resignation served by you shall stand cancelled.

It shall be good as a goodwill gesture to explain the situation {after getting the offer in writing from current employer} in person, on phone to new company’s line managers/HR { on phone/in person}and cancel the offer made by them in writing. Think and give some good reason so that the company cancels the offer without any debate.

I agree with Krishnan. You can politely communicate by emial that you have reconsidered the proposal and not accepting the offer. Don't disclose  about the offer given by the present employer.
