My client received Execution Notice, he filed protest application with affidavit. But execution proceedings is initiated against him despite his protest,, andeveryone knows that execution is proceeded against wrong person. I want to quash this proceedings. Should I use Certiorari, prohibition, quo wrranto or mandamus or all under Article 226.

sycorax.juris, your query sounds like question on third eye, good query.I am of the firm view and convienced that appeal and not writ is the proper means. You can wait and see what other learned members will comment.

N.K.Assumi, third eye or second eye, this is too much and I want to go for quashing and not appeal. I hope other members will feed me on this issue.
