Rental delay by the tenant

 

Hi Guys,

This is my first ever post on this website. 

To start with, we (Landlord "Lessor": Total 4 family members along with me) have entered into lease aggreement with one of the famous Indian Institutes "Lessee" (Field: Education) 6-7 months ago. We had a clause in the lease agreement (Such as: Lease fee/Monthly Rent shall be paid by the Lessee to the Lessor regularly by the fifth day of every month in advance). Our Tenant paid rent on time for first 2-3 months but after that they have not been paying timely rent, sometimes it's 2 weeks late, sometimes 3 weeks or more but they are not concerned about it all. In fact, when we receive rental cheques, they are always back dated as per the clause. For ex: Rent has to be paid by 5th of every month, and if i am receiveing cheque on 24th, it looks like cheque was issued before 5th but given to us after 2-3 weeks. They have made a habit of doing this and they are not puntucal at all. They want to look good in books by issuing backed cheques but they always hold cheque with them and give it to us when we call/email them several times (We really get frustrated every month).

Since they are a big name so every person we speak to in their company, direct us to someone else. No one wants to take this responsibility. Area Marketing Head (In our area) and Accounts Manager (In our area) are good for nothing though they are the incharge of property where institute is currently located. Moreover, General Manager-Administration & Liaisoning, who acted on behalf of company's, is a considered as Lessee on the lease agreement, is also not very helpful. He was good at initial stage but now he's also not taking any resonsibilty of anything. He is denying by the fact that he is responsible for anything though his name is there in the Lease agreement. He guided us to the Finance Head of the Entire Region, who should be responsible for paying prompt payment to us. I spoke to and emailed this guy but now he is not responding. He says on the phone don't email for rental payment, but at the same time he doesn't act for issuing our rental cheques. This is now a usual drama and we are helpless. They have never accepted thier fault and never replied to our emails. It's us who call them and write them 1000 times but that doesn't bother them at all.

Please guide us and instruct us, what to do, as according to this big company issuing late cheque is not a very serious thing and for us it is an every month's drama. We don't want to look like needy before them and i really want to make a stop to thier unprofessional approch.  PLEASE HELP!!!
