Rented shop on lease

Dear Sir,

My father has Rented shop since 40 year on pagri. Now my father is expired and shop is under my custody.

Is there any way that shop owner can claim their shop as original tenant is expired or the shop will be mine as i am the immediate successor of my father.


Kindly suggest soon as these days he is escaping to give the rent receipts as i am ready to give  advance one year rent.

Also tell me procedure how to submit the rent amount in court if owner is denying to given rent receipts.

A. "immediate successor" is immatterial, imp is that legal heir should ordinarilly doing business with original tanent till his death.

B. Ask his bank account no. details by seving notice by reg A D post at his correct adress stating all facts . If he ignores notice send him rent through M. O. at his correct adress including the rent for which he has not issued receipt.

C. In Rajasthan rent control act 2001 there is no provision to deposit rent in court kindly go through your State rent laws.
