Resale flat noc from builder

Hello all

Consider the following scenario which has not happened in reality but can take place.

assume that I am buying a resale apartment flat in Pune. The Apartment Deed is not yet done.

The seller has asked for No Objection Certificate from the builder. However the builder will give the NOC for some cash amount in return from the seller as well as the buyer. Assume that the seller gives the cash to the builder and the builder gives him NOC. The buyer however does not pay any amount to the builder. 

In this case, can the builder create problems in future for the new owner (buyer in above scenario) ? (since the deed of apartment is not done)

For binding legally,you have to execute an assignment deed wherein the seller should assign his right and interest in the property to the buyer's name(new owner).Your hypothetical questions do not yield   any positive results.
