I am working in a private academic institute as assistant professor. I am resigning my job. The employer hold my original certificates. They are asking for two month salary to relieve and give back my certificates.
Statements from the service conditions "16. Every staff or the management is entitled to have the service terminated either by giving one month notice or one month basic salary in lieu thereof in case of temporary appointment or during probationary period.
(a) In addition to the payment of salary as mentioned above, the employee who leaves the service, must also pay the charges towards making advertisements."
I gave them one month notice. In this case whether the subclause 16. (a) is applicable to me or not.
