Resigned but waiting for settlement.

Sir,

i have been working in a company since Dec2012 - March 2014.

In this span of time I received only 3 months salary,on the contrary I my own money for company expenses and utilities,despite repeated reminders and request I was always convinced by false promises and wrong commitments to be getting the payment very next month.

On the other side I casted my own money to the accounts dept towards the staff salaries and utilities as the company account was weak and lack funds,which was never returned back.

When I request for my due salaries and borrowed amount,I was put on hold for months,as the situation indicated negative intensions of the company for settling down my account-therefore I resigned and the next day received a statement of account from my company mentioned with all due,but lastly a clause says,"this amount will be settled with the directors approval and convince....this happened 4 months back i.e.; on 02/04/2014.

since then no action has been taken to focus on my matter,despite reminders and requests I got a zero response from the company.

Please guide me in this matter where to approach and also need to know if the labour commission will entertain me as my salary is mentioned above Rs 25000 in the offer letter.

Firs serve a legal notice  demanding the amount due to you, based on their reply, you may choose further course of legal action on this issue.  Consult a local labor law practicing lawyer with full details and take his advise on the subject query.

If the monthly salary of Mr Moin is above  Rs 18000/- he cannot claim is unpaid salary.Subject to his terms of appointment he can approach civil court for his dues.

It is a mistake for an employee to spend from his pocket for Co unless it has a system of prompt reimbursement.If Moin is a non workmen he cannot any dispute under ID Act.
