resolutions passed by Ex MC in a cooperative housing society

dear learned advocates,

I wish to know if the resolutions passed by the ex MCs of cooperative housing societies are null and void after a new MC is formed.

or can we amend or cancel some resolutions passed by MC in the AGMs/SGBMs/EOBMs which violated the provisions of the Maharashtra Cooperative Housing Society Act 1960/ Model code of society act 2014.

your immediate valuable legal views are appreciated

thanks in advance

Best regards

The resoultions passed by ex MC if they are not in power then it is invalid, however if the resolutions were passed during their  tenure as MC then it is very much valid.

If the resolutions are ultra vire or contradicting the law then a resolution may be passed in the AGM/SGM  to nullify the unlawful and illegal resolutions passed earlier and the minuted latest  resolution may have to be approved by the deputy registrar for taking the changes into effect.
