My father-in-Law expired in 1986. After some years the relationship between my wife (Eldest in the family) and her brothers (Three) strained over looking after her Mother at home. we live in Delhi. One Eldest son, i.e., my wife's first younger brother lived for some years there in a two-room of ground floor and after that he left the house locked and after some time he rented out the two-rooms and earing the rent. In order to keep the mouth shut he pays a faultry amount to his mother who does not have her own place to stay, either stays with my wifes second younger brother or with the third, the last younger brother of my wife. Totally she lives with whims and fancies of hers sons. Now few years back all the three sons wanterd to divide the property. When my wife insisted that the property should be divided into five share including my mother-in-Law, they refused say ing only four shares. Since the position of my Mother -in-Law shall be weak if the property is divided into four my wife denied. The sons have the impression if it is divided into five share my mother-in-law may give her share to someone which they do not want to be happen. Now my wife for the last seven/eight years whenver she goes to her mother's place she has to adjust with the brother who is looking after her mother since all brother have got married and thus she stopped going to her mother's place for the last four years but could stay for half day or few hours. She feels suffocated whenever she goes there mainly becauser all their marraiages have been materialized without consultation or consent but only informing few days back to attend the marrigae. With this background whether my wife can file a case (1) for generating income from the undivided property; (2) No separate room/s is allotted for her stay whenever she visits her mother; ( some modification in the second floor is made without my wife consent and therby occupying the full second floor which had four rooms ); (3) whether my wife can ask for compensation for renting out the undivided property, not allotted or made arrangement with privacy to stay there for many years, modification done without her consent. Besides all, my mother-in- law has to stay with them since no separate arrangement has not been made for her which she herself does not want to because nobody can look after her if she ask for the same as she has no source of income. In that precarious situation what my wife should do? Though she wants her mother to with her in Delh, her mother refuses because of long distance.
