Subject: Hindi II appeal:RTI 21.2.13

Kindly be informed herewith that second appeal as attached in official language of the Union of India,that is, Hindi to central information commission in respect of my RTI application dated 21.2.2013 is being filed  herewith  as  per  attached annexures  in respect of denial of information by CPIO and FAA. Despite transfer of application under section 6(3) by the Ministry of finance (appropriate Central Govt. that controls the administration of insurance company as per the General Insurance Act ) thus  Right to Information of  the appellant  seeking information of systematic corruption in  public employment  was denied.

Article 343 in The Constitution Of India 1949
343. Official language of the Union
(1) The official language of the Union shall be Hindi in Devanagari scripttt The form of numerals to be used for the official purposes of the Union shall be the international form of Indian numerals
(2) Notwithstanding anything in clause ( 1 ), for a period of fifteen years from the commencement of this Constitution, the English language shall continue to be used for all the official purposes of the Union for which it was being used immediately before such commencement: Provided that the president may, during the said period, by order authorise the use of the Hindi language in addition to the English language and of the Devanagari form of numerals in addition to the international form of Indian numerals for any of the official purposes of the Union
(3) Notwithstanding anything in this article, Parliament may by law provide for the use, after the said period of fifteen years, of
(a) the English language, or
(b) the Devanagari form of numerals, for such purposes as may be specified in the law

 

Official language rules 1976 stipulate,inter alia

5. Replies to communications received in Hindi - Notwithstanding anything contained rules 3 and 4, communications from a Central Government office in reply to communications in Hindi shall be in Hindi.

6. Use of both Hindi and English - Both Hindi and English shall be used for all documents referred to in sub-section (3) of section 3 of the Act and it shall be the responsibility of the persons signing such documents to ensure that such documents are made, executed or issued both in Hindi and in English.

Every insurance company of p[ublic sector is a deemed office of Central Govt as per the Official Language Act
