Person's income tax details can’t be revealed under RTI unless public interest overrides privacy concerns: SC

 
NEW DELHI: The income tax details of an employee cannot be revealed underRTI as a rule, but an exception could always be made in public interest, theSupreme Court has said.
The court said in a judgment delivered on October 3, 2012, that the income tax details of a person can't be revealed under RTI unless public interest overrides privacy concerns.
Such information is usually personal with no relationship to a person's public activity or public interest, it said. On the other hand, disclosure of such information may cause unwarranted invasion of an individual's privacy, the court said.
Performance of an employee is primarily a matter between him and the employer and is governed by service rules, which falls under "personal information", the court said.

The above judgement lacks the practibility in indian context. Any document filed before an office constituted under the act passed by the parliament or the assembly is termed as a public document and in that case everybody has got a right to access the document, and with this aim the right to information act was passed. When the misdeed of these nacked politician are exposed this unpopular government is going to pass a Privacy Act, just to save themselve from being caught. Less said against these politican are better. Few years ago an NRI came to india and had the opportunity to having the taste of availing the civic amenities under the municipal corporation in India. After he failed to get any response from the authorities he said "ONLY GOD KNOWS HOW THIS COUNTRY IS RUNNING" left the country.
