Sale of unapproved land

My brother  bought a residential land apparently approved by chennai metropolitan development authority in 2001 and sold it as such to a buyer in  2011 without altering anything mentioned in his purchse document. .. 

But, the buyer who applied for buiding plan permission  was told that the land itself is un approved as so it has to be got approved.

For this, the buyer demand compensation from my brother under the pretext that higher sale price has been paid for the   unapproved land   ..

What are the consequences , if the buyer sues my brother and how much has to be paid ?

After getting the simutaneaous land and building plan approval  , can the buyer still has a right to demand compensation?

 

Here, please note that there is no defect in the title and the ownership of the land.
