SC advices lawyers

The Supreme Court, which on Thursday acceded to most of the demands of the agitating lawyers of Tamil Nadu, expressed displeasure over their conduct during the strike and asked them to maintain judicial decorum and discipline.

The lawyers have no business to go to court and attack anyone. Laywers have responsibility to respect the court and maintain decorum," a three-judge Bench headed by Chief Justice K G Balakrishnan said. The bench, also comprising Justices P Sathasivam and J M Panchal, was anguished that despite meeting most of the demands of the striking lawyers, they were demanding suspension of police officers responsible for the February 19 clash between advocates and police in the Madras High Court premises.



"We cannot simply accept everything," it said.



"I have been in the Madras High Court for one year. Lawyers used to hold meetings in the court and shout slogans on the corridors of the court," the CJI said.



"There are lawyers who have allegiance to some or other political parties but that in no way mean that they can hold meetings in the court complex when arrangements are already in place for the lawyers body," he said.



However, Balakrishnan said "I don't blame all lawyers" and asked the lawyers to think about the plight of litigants who are the worst sufferer due to strikes.



"Lawyers are on strike. Large number of litigants are suffering. This is very sad incident," he said.



Ex-SC judge suggests emergency



Former Supreme court Judge, Justice VR Krishna Iyer has suggested promulgation of emergency in Chennai with the plenary power of the State Administration vested in a group of senior most judges of Supreme Court to 'prevent justice, which is fundamental to rights, being made a cadaver.'



If such an extraordinary measure is not taken by the Central cabinet, India's Independence would be annihilated by the 'Khaki domination' which was a 'law unto itself,' he said in a strong-worded statement here.



He said police had put out a version making the lawyers the villain. The lawyers version went by default, and even judges proved powerless. The Highest Institution of Justice in the state "stands scandalized and stultified and the forensic process was penalised with the constitution made a paper tiger," he said.



"The grave collapse of the rule of law is a national catastrophe of people's sovereignty. He sought withdrawal of police from Madras High court premises and compound. 'The Police Commissioner and DGP should be suspended or else all the judges of court should resign until judiciary restored to its power and dignity and the court truly hallowed and absolute peace restored,' he said.



Delhi HC lawyers to abstain from work



To express their solidarity with their protesting colleagues in Chennai High Court against police "atrocity", lawyers of Delhi High Court Bar have decided to abstain from attending the court tomorrow.



The Delhi High Court Bar Association said following a call given by the Bar Council of India(BCI) to observe February 27 as the protest day, the DHCBA, in order to mark its protest "against police atrocities on innocent lawyers" has decided the abstain from attending the courts tomorrow".



"The unfortunate action of police entering into the court premises and indulging in wanton attack on the judges and lawyers of Madras High Court is unprecedented in judicial history," said K C Mittal, President, DHBA.

 

But this grave issue needs to addressed insantly since its an insult to the third pillar of our society.

March 2: Tension prevailed in the Villupuram integrated court complex as two group advocates exchanged blows over differences over attending courts. Early on Monday, a 10-member team of DMK advocates led by Adhi-sankar of Tirukovilur att-ended the courts rubbishing the call to boycott work since the February 19 violence in Madras high court.

Sources stated that another team of advocates belonging to Tamil Nadu Puducherry Lawyer’s Confederation waylaid the DMK lawyers while they were returning from the court.

The two groups were involved in an altercation.
