Sec 294 Cr.P.C.

 

Sirs, in a criminal complaint, the complainant moved an application u/s 294 Cr.P.C. for calling upon the accused to admit or deny the genuineness of documents filed alongwith complaint.

The Magistrate has dismissed the application on the ground that the copies of the documents in question supplied to the accused are not legible.

The complainant wants to file a revision Petition. Kindly advise and help with case-laws. Regards.

if the documents which are not public documents,are sought to be relied on by the prosecution  by the  only question of proof of those documents  and signatures would arise. ---md akbar and anr vsstate of A P2002 Cri L J3167 A P.no body prevent against a cri. rev but you must produce a document which is readable or can be recovered.

File the legible documents in the same court and again make request for A and D under Sec. 294 of Cr.P.C. no need to file revision petition.

sir,

s.294 enables marking document when otherside admit genuiness of documet.

u may have to provide list and call upon otherside again and read in evidence
