Dear Sirs,
10 consumer booked flats in a project on differnet dates and agreement also made on different date .The mentioned project has 100 flats for sale and builder commited the possesion in Dec 2015 .Till date posssesion not given by the builder .Now 10 persons from the project seeks to file a joint complaint at NCDRC for possesion and some common amenities .Agreegate value of the flats of these 10 persons is 2..5 cr and they have paid approx 1.5 cr to builder tilln the time .Need clarity on below mentioned points considering the larger bench decesion in CC/97/2016
1.Is representative case possible in this case ?
2.If representative case filed under sec 12 (1) (c) then asking for the possesion and compensation for the delay possesion is valid as per the case law mentioned above,if not which is the correct sec to file the complaint in joint form and ask for the possesion and compensation for the delay posssesion
