section 138

I could not pay 3 emi of my icici home loan. I got a call from the bank asking for the payment of emi otherwise they will get my cheques bounced and file a criminal case under section 138. can a bank do so on failure of payment of emi?? my emi is rs 11507 and outstanding principal amount is rs 1050000. plz suggest.
