Hi all, We have a case in our family where our father got falsely implicated in a section 354 charge. He is a 56 years old man travelling in bus where he accidentally hit the head of a woman on sudden brake. The lady filed a complaint of touching her waist continuously and that he asked her to shut up when asked about the same. He was in jail for 5 days and then released on bail. I would like a rational approach on this case keeping the emotional part aside which I am already going through. Please comment on our strengths and weaknesses. The father of the lady initially said he is ready for compromise but he is not responding now. They have'nt demanded any money yet.
I have read the statements of so called witnesses where none of them wrote that they saw the actual act but that the lady told them about this. Wont this come under hearsay evidence?
I am researching since the last 3 weeks about this and I found a citation named "1972 Allahabad Cr. Reporter 361" which sums it up as "Also catching a woman by neck or even if it is assumed that accused also caught hold of the waist of woman aged 30 years, it cannot be said that modesty of a woman is outraged or sought to be outraged" Any thoughts on how to get the old case details with this citation number?
