Housing societies/builder do not have to pay service tax on maintenance charges collected from their members, a tax tribunal has ruled in Mumbai.

It is very unfortunate that we need orders from tribunals and courts even for very simple things. A housing society is a self-help society. There are no service providers and service receivers. They should not come under the Consumer Protection Act either for the same reason. Even eminent lawyers and judges of consumer courts do not realise this.
